AGREEMENT OF PARTICIPATION IN THE EVENT
WHEREAS the organisers have organised an event known as the Corporate Challenge, (Hereinafter referred to as “the event”) on Friday 13th of October 2023.
WHEREAS I am aware that the event is a sporting event which involves various challenging obstacles on a course, taking place within the property of Maseru Mall, inherent with the risk of serious injury, illness, death and/or damage to equipment.
WHEREAS I am desirous of partaking in the event.
WHEREAS I have the required level of skill, ability and experience as a sport participant to participate in the event. I declare further that I have taken proper precautionary measures to ensure my physical fitness and that my fitness and health is at the recommended level required for the event

WHEREAS I understand the risks inherent in the event and my participation therein.
RELEASE OF LIABILITY: I hereby release, discharge, and hold harmless CORPORATE CHALLENGE , its employees, agents, officers, and any affiliated sponsors or volunteers from any and all liability for any injuries, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury that may occur as a result of my participation in the Corporate Challenge Team Building Event.
ASSUMPTION OF RISK: I understand and acknowledge that participating in the Corporate Challenge Team Building Event involves physical and mental challenges, which may include, but are not limited to, team-oriented activities, obstacle courses, and physical exercises. I am aware that these activities may involve risks and hazards, including the risk of personal injury or property damage. I voluntarily choose to participate in this event, fully understanding the potential risks and dangers involved.
NOW THEREFORE

It is hereby agreed that reasonable safety and precautionary measures are taken by the event organisers to ensure my safety, the event organisers, sponsors, third party service providers to the event, private landowners who grant access to their property for the purposes of the event and their principals, representatives, agents and assignees the organisers do not accept any responsibility for any claim whatsoever arising from death, injury, illness or loss and/or damage to person or property occasioned as a result of my participation in the event.

I undertake to follow all the rules of the event and all directions and/or instructions given to me by the organisers of the event and their principals, representatives, agents and assigns.

I exonerate the organisers from any harm that may be caused to me by the nature of the terrain traversed, condition of the road surface, weather conditions, water conditions, vehicular traffic, the actions of other competitors, sponsors and their principals, representatives, agents and assigns. I understand that the responsibility to prevent such harm and to take any measures to minimise the harm shall rest exclusively with me.

I accordingly hereby indemnify and absolve the organisers to the fullest extent possible in law, against any claims occasioned as a result of my participation in the event of whatsoever nature or howsoever caused, including, without limitation, any loss, injury, harm, illness, death or damage of whatsoever nature and howsoever caused arising directly or indirectly out of any act or omission, including negligent acts or negligent omissions by the parties, including any claim for consequential loss or damage, loss of profits or any claim by any of my dependants arising from events related to, in connection with or occasioned as a result of my participation in the event.

I understand that I may be photographed and/or filmed before, during and after the event. I agree that the event organisers, sponsors and their principals, representatives, agents and assigns may utilise any photographic, film or video image or likeness of me and my name for any legitimate purpose in connection with the event or future events to be organised by the event organisers.

I confirm that I understand the import and meaning of this liability disclaimer, the waiver of claims and the indemnity and, that by agreeing hereto, I am waiving substantial legal rights (on my own behalf and on behalf of my dependants).
